The EU Whistleblower Directive aims to enforce EU law and to detect or prevent violations. Whistleblower protection serves as a tool to achieve this goal by
- protecting whistleblowers from retaliation,
- reducing the fear of reporting through protection against retaliation,
- using reports to help uncover, penalize, or prevent violations.
To realize whistleblower protection, the directive contains provisions for companies and organizations to set up reporting channels. These reporting channels or whistleblower systems must be designed to protect the whistleblower's identity.
The regulation applies to:
- Companies with 250 or more employees (Deadline: December 17, 2021)
- Companies with 50 or more employees (Deadline: December 17, 2023)
- Municipalities with 10,000 or more inhabitants
- Public sector institutions
- Authorities

The EU directive mandates that companies must offer reporting channels designed to ensure the confidentiality of the whistleblower's identity. Evermood ensures the required protection of identity by enabling anonymous reporting. Anonymity is achieved through the following technical means:
- End-to-end encryption of all messages and attachments between the whistleblower and the recipient.
- The system does not store any data that could identify the whistleblower (IP address, location data, device specifications, etc.).
- Transport encryption of all messages and attachments.
- Encryption of all data stored on the databases of the reporting platform and case management.
- Regular IT security audits (penetration tests) to check system security.
With traditional telephone reporting, the 100% anonymity of the whistleblower cannot be guaranteed – even with suppressed phone numbers, for instance, the voice could potentially provide identifying information.
There is the option to designate either internal ombudspersons (e.g., Compliance Officer, Legal Department, HR Management) or external ones as the initial contact in the whistleblowing system. If an external ombudsman is designated by the customer's request through Evermood in the whistleblowing system, they are responsible for gathering the facts through communication with the whistleblower and forwarding the information to the customer through reporting.
The time required for fact-gathering and reporting depends on the individual case. Costs are incurred only in the event of a case and are at 300 Euros per hour. The charges are billed on a half-hourly basis. Typically, two hours are required for fact-gathering on smaller issues.
If the fact-gathering and reporting require more than two hours of effort, the Evermood ombudsperson will obtain written consent from the customer to either pursue a more extensive fact-gathering, consulting & investigation or to hand it over to a responsible internal department.
